The Rogers Team is a real estate team affiliated with eXp Realty. Real estate brokerage services are provided through eXp Realty and under the supervision of the applicable licensed broker as required by New York State law. The Rogers Team is not a separate licensed real estate brokerage unless expressly stated in writing and authorized under applicable law.
If you are a visitor to this Site, this Privacy Policy and Terms of Use applies to you and describes the policies and practices regarding the collection, use, and disclosure of your personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us in providing the Services solely in their capacities as service providers and data processors.

We collect information from you in various ways when you access or use the Site, complete a form, request real estate information, inquire about a property, request a home valuation, schedule a consultation, register for an event, communicate with us, or otherwise interact with the Services. Contact information that you provide, such as your first and last name, email address, home address, property address, and phone number; real estate information that you provide, such as buying goals, selling goals, relocation goals, investment goals, preferred locations, price range, property type, timing, property condition, home features, lifestyle preferences, and other information related to your real estate needs; feedback or correspondence, such as information you provide when you contact us with questions, feedback, reviews, testimonials, or other correspondence; marketing information, such as your preferences and/or consents for receiving communications about our listings, services, events, market updates, educational materials, and publications, and details about how you engage with such communications; and other information which you may provide voluntarily or that is necessary in connection with your interactions with us through the Site or Services.
If you are involved in a potential or actual real estate transaction, we may also collect information relating to property searches, listing appointments, showing requests, open house registrations, offer activity, purchase or sale timing, attorney information, lender information, proof of funds, mortgage pre-approval status, transaction milestones, inspection information, title-related information, and other information that may be needed to provide real estate services, subject to applicable law, brokerage policy, and transaction requirements.
You should not submit Social Security numbers, bank account numbers, wire instructions, copies of government identification, tax records, financial account information, or other sensitive information through general website forms unless we specifically provide a secure method and the information is necessary for a legitimate real estate purpose.
Social media information: We may maintain pages on social media platforms, such as Facebook, LinkedIn, Instagram, YouTube, TikTok, and other third-party platforms. When you visit or interact with these pages, the platform providers' privacy policies will apply to your interactions and their collection, use, and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy and Terms of Use.
Real estate and property information: We may obtain information from property records, public records, MLS/IDX providers, real estate platforms, showing platforms, title-related sources, municipal sources, tax records, prior transaction records, and other lawful real estate data sources. This information may include property ownership information, property characteristics, tax information, listing history, sales history, market activity, and similar information.
Data enrichment sources: We may obtain additional information about you from third-party data providers, including property records and public records databases, demographic and behavioral data providers, social media profile information where publicly available, and other commercially available data sources. This information helps us provide more relevant services and communications.
Referral and transaction sources: We may obtain your personal information from referral partners, other real estate professionals, lenders, attorneys, inspectors, title companies, insurance professionals, home service providers, relocation partners, or other parties involved in real estate services or transactions.
Other sources: We may obtain your personal information from other third parties, such as third-party analytics services, marketing partners, publicly available sources, advertising partners, and data providers.
If you communicate with us via email, text message, phone, direct message, website chat, online form, social media message, or other electronic means, or if we use customer relationship management ("CRM") tools to manage our interactions with you, we may collect and process: email message content, headers, metadata, and attachments; text message content and metadata; call notes, call history, and voicemail information; communication timestamps, read receipts, and delivery status; contact information and communication history; property preferences and search history; and notes and records relating to our interactions with you.
Our CRM services may synchronize with email accounts, calendar tools, texting platforms, website forms, lead-generation platforms, advertising platforms, and other communication tools to facilitate communication management. When synchronization is enabled, information from communications exchanged with you may be processed and stored, including email content, sender and recipient information, timestamps, attachments, text messages, call notes, appointment details, and follow-up activity. This data is used to provide better service, maintain accurate records, and facilitate timely follow-up communications.
We and our Service Providers may automatically log information about you, your computer or mobile device, and your interaction over time with our Services, our communications, and other online services, such as: device data, including your computer's or mobile device's operating system type and version, manufacturer and model, browser type, screen resolution, device type, IP address, unique identifiers, language settings, mobile device carrier, and general location information such as city, state, or geographic area; and online activity data, such as pages or screens you viewed, how long you spent on a page or screen, browsing history, navigation paths between pages or screens, information about your activity on a page or screen, access times, duration of access, form submissions, search activity, property views, saved property activity, and whether you have opened our marketing emails or clicked links within them.

To provide and operate our Services and our Site: We use your information to provide, operate, and improve our Services and Site; communicate with you about our Services and business including by sending announcements, updates, security alerts, support messages, administrative messages, listing information, market updates, appointment reminders, and transaction-related communications; and provide support and respond to requests, questions, feedback, property inquiries, valuation requests, consultation requests, and showing requests.
To provide real estate services: We use your information to assist with buying, selling, relocating, investing, leasing, valuation, listing preparation, property searches, market analysis, consultations, open house follow-up, showing coordination, offer preparation, transaction coordination, client service, and related real estate services.
To manage our relationship with you: We use CRM tools and services to maintain records of our communications, track your preferences and interests, organize follow-up activity, provide personalized service, and understand your real estate goals. This may include analyzing your interactions with us to better understand your needs, preferences, timing, and service expectations.
To send you follow-up communications: If you have opted into receiving follow-up communications or otherwise provided your contact information in connection with a real estate inquiry or service request, we or our Service Providers may from time to time send you follow-up communications as permitted by law, including through phone, email, direct message, and SMS text messages, some of which may use automated systems, artificial or prerecorded voices, or automated dialing technology where permitted by law. You may opt out of receiving such communications as set forth in Section 6 below.
To send you marketing and promotional communications: If you have opted in to receive marketing and promotional communications, requested information, interacted with our Site, or otherwise provided consent where required, we or our Service Providers may from time to time send you direct marketing communications as permitted by law, including through phone, email, direct message, and SMS text messages, some of which may use automated technology. These communications may include listing alerts, market updates, home valuation information, buyer resources, seller resources, relocation resources, investor resources, luxury property information, newsletters, event invitations, and other real estate-related content. Other than as set forth in Section 4 below, your information will not be shared with third parties for their own marketing or promotional purposes. You may opt out of receiving such communications as set forth in Section 6 below.
To comply with law and real estate brokerage obligations: As we or our Service Providers believe necessary or appropriate, we may use your information to comply with applicable laws, regulations, lawful requests, legal process, New York State real estate licensing rules, fair housing requirements, brokerage supervision requirements, MLS rules, recordkeeping obligations, transaction requirements, subpoenas, court orders, or requests from government authorities.
For compliance, fraud prevention, and safety: To protect our rights, privacy, safety, business, property, clients, users, eXp Realty, Service Providers, or others; make and defend legal claims; enforce the terms and conditions that govern our Services; prevent unauthorized access; detect and deter fraud; investigate unlawful, unethical, harmful, or unauthorized activity; and protect the integrity of our Site, communications, listings, and Services.
To create anonymous data: We may create anonymous, de-identified, or aggregated data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, de-identified, or aggregated data by removing information that makes the data personally identifiable to you. We may use this data and share it with third parties for our lawful business purposes, including to analyze and improve our Services, conduct research, prepare market insights, measure advertising performance, and promote our business.
The Rogers Team is a real estate team affiliated with eXp Realty. The Rogers Team is not a separate licensed real estate brokerage. Real estate brokerage services are provided through eXp Realty and under the supervision of the applicable licensed broker as required by New York State law.
Only a licensed real estate broker may place or authorize certain real estate advertising under New York State real estate advertising rules. Any real estate advertising, listing promotion, property marketing, team marketing, website content, or digital advertising related to real estate services is intended to be made with proper brokerage identification, approval, and supervision where required.
Use of this Site, submitting a form, receiving a property alert, downloading a guide, requesting information, or communicating with us does not by itself create a broker-client relationship, agency relationship, fiduciary relationship, exclusive representation agreement, or obligation to represent you. A real estate brokerage relationship is created only when required disclosures have been provided and the applicable written agreement, acknowledgment, or representation relationship has been established under applicable law and brokerage policy.
New York State law may require real estate licensees to provide agency disclosure forms in certain residential real estate transactions. When required, the appropriate New York State agency disclosure form will be provided at the required time.
The Rogers Team and eXp Realty are committed to compliance with federal, state, and local fair housing and anti-discrimination laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity or expression, lawful source of income, marital status, military status, age, creed, domestic violence victim status, or any other protected class under applicable law.
The Site should include access to the New York State Fair Housing Notice where required. The Site should also include or link to the applicable Standardized Operating Procedures for prospective homebuyers as required under New York law and brokerage policy.
Prospective homebuyers should review the applicable Standardized Operating Procedures before receiving real estate brokerage services. Sellers, listing brokers, property owners, buildings, management companies, homeowner associations, cooperative boards, condominium boards, or other parties may impose additional lawful requirements for showings, open houses, offer submission, identification, proof of funds, pre-approval, board packages, or property access.
The Site may display property listings, IDX data, MLS data, valuation tools, market information, sold data, neighborhood information, school information, and other real estate content. We strive to provide accurate information, but real estate information changes frequently and may contain errors, delays, omissions, price changes, prior sales, withdrawn listings, pending listings, sold listings, tax changes, school boundary changes, zoning updates, HOA updates, or other changes.
All property information is deemed reliable but is not guaranteed and should be independently verified. Buyers, sellers, landlords, tenants, investors, and developers should consult appropriate licensed professionals, attorneys, lenders, inspectors, appraisers, title professionals, insurance professionals, accountants, municipal offices, and other qualified advisors before making real estate decisions.
Any information regarding pricing, market value, estimated sale proceeds, estimated rent, investment return, days on market, property condition, appreciation, taxes, school districts, zoning, permits, HOA rules, or financing is for informational purposes only and is not a guarantee of any result.
We may use artificial intelligence ("AI"), machine learning technologies, automation tools, and related technology to provide and improve our Services. This section describes how AI may be used in connection with the Site and Services.
We may use AI technologies to generate, assist with, or enhance content displayed on the Site or provided through our Services, including: property descriptions and listing information; blog posts, articles, and other written content; social media posts and marketing materials; email communications and newsletters; buyer guides and seller guides; advertising copy and promotional content; internal notes; and client service workflows.
AI-generated content is created using large language models and other machine learning systems. While we may review AI-generated content for accuracy and appropriateness, such content may contain errors, omissions, outdated information, or inaccuracies. You should not rely solely on AI-generated content for important decisions, including real estate transactions, legal decisions, financial decisions, tax decisions, mortgage decisions, investment decisions, or property-related decisions, without independent verification and consultation with qualified professionals.
We may use AI to assist with communications, including: drafting and suggesting responses to inquiries; analyzing communication patterns to improve service; providing automated responses to common questions; organizing client preferences; prioritizing and categorizing incoming communications; and helping us provide timely follow-up.
When AI assists with communications, a human may review and approve messages before they are sent, though some automated responses may be sent without individual human review.
We may use AI to analyze data and provide recommendations, including: identifying potential opportunities based on your stated preferences and behavior; suggesting properties that may match your criteria; analyzing market trends and conditions; estimating communication timing; organizing property search priorities; and optimizing the timing and content of communications.
These AI-based analyses and recommendations are provided for informational purposes and should not be considered professional advice, legal advice, financial advice, tax advice, appraisal advice, or a guarantee of results. Important decisions should be made in consultation with qualified professionals.
You may request information about whether AI was used to generate specific content; request human review of significant communications or recommendations where reasonably available; opt out of certain AI-powered features where technically feasible; and provide feedback on AI-generated content or recommendations.

We do not "sell" any personal information as that term is commonly understood, but we may share your personal information as described below and as described elsewhere in this Privacy Policy and Terms of Use. We may share your personal information with:
Internal Team, Brokerage, Partners, and Affiliates: Our licensed real estate professionals, employees, contractors, administrative support, transaction coordinators, marketing support, partners, affiliates, supervising brokers, compliance personnel, and brokerage personnel, including to facilitate your interactions with us, provide real estate services, manage communications, support transactions, and comply with brokerage requirements.
Our Service Providers: Companies and individuals that provide services on our behalf or help us provide the Services, the Site, or our business, such as hosting, website management, information technology, CRM services, email delivery, SMS delivery, call systems, AI and machine learning services, calendar tools, appointment tools, data storage, cybersecurity, website analytics, advertising services, marketing automation, transaction-management systems, and customer support.
Real Estate Transaction Participants: When appropriate for your requested services or transaction, we may share information with sellers, buyers, listing agents, buyer agents, cooperating brokers, attorneys, lenders, mortgage professionals, inspectors, appraisers, title companies, insurance providers, contractors, property managers, homeowner associations, condominium associations, cooperative boards, municipal offices, MLS providers, showing platforms, transaction platforms, and other parties reasonably necessary to facilitate a real estate inquiry or transaction.
Professional advisors: We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors, accountants, consultants, and insurers, where necessary in the course of the professional services that they render to us or our Service Providers.
For compliance, fraud prevention, and safety: We or our Service Providers may share your personal information for the compliance, fraud prevention, and safety purposes described above.
Business transfers: We or our Service Providers may sell, transfer, or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction or potential business transaction such as a corporate divestiture, merger, consolidation, acquisition, reorganization, sale of assets, transition of service providers, or in the event of bankruptcy or dissolution. There are a number of ways to opt out of having your online activity and device data collected through our Services: blocking cookies in your browser, because most browsers let you remove or reject cookies, including cookies used for interest-based advertising; blocking advertising ID use in your mobile settings, because your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes; and using privacy plug-ins or browsers that can block analytics or advertising cookies.

The retention period for personal information depends on the context and our relationship with you: contact information and communication records are generally retained for the duration of our relationship with you and for a reasonable period thereafter to allow for follow-up communications and to comply with legal requirements; CRM data, including email synchronization data, is retained for as long as you maintain an active relationship with us, unless longer retention is required or permitted by law, brokerage policy, or legitimate business needs; transactional records may be retained to comply with legal, regulatory, brokerage, MLS, tax, accounting, and recordkeeping requirements; marketing preferences are retained until you update them or opt out; and website analytics may be retained in aggregated or de-identified form for analytical purposes.
Real estate transaction records, communications, agency disclosures, signed documents, offer records, showing records, listing records, and compliance records may be retained as required or recommended under applicable law, brokerage policy, MLS rules, insurance requirements, and professional standards.
When personal information is no longer necessary for the purposes for which it was collected, we will take reasonable steps to securely delete, archive, or anonymize it. In some cases, we may retain certain information in anonymized or aggregated form for analytical, compliance, training, or business purposes.
The Site and Services may contain links to websites and other online services operated by third parties. In addition, our content may be integrated into web pages, platforms, MLS/IDX systems, property search tools, social media platforms, advertising platforms, map tools, video platforms, payment tools, scheduling tools, mortgage calculators, valuation tools, or other online services that are not operated by us.
These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party unless expressly stated. We do not control websites or online services operated by third parties, and we are not responsible for their actions, privacy practices, security practices, content, accuracy, or terms.
We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect. We take reasonable technical and organizational measures intended to provide a level of security appropriate to the risk of processing your personal data. These safeguards may include access controls, password protection, secure platforms, vendor controls, staff training, limited access to personal information, monitoring tools, backups, and other reasonable security practices.

Real estate transactions are vulnerable to wire fraud and other cybercrime. We will not be responsible for losses caused by fraudulent wire instructions, impersonation, email compromise, phishing, spoofing, or other unauthorized third-party activity. You should independently verify all wire instructions, payment instructions, and sensitive transaction instructions by calling a trusted, verified phone number for the appropriate attorney, title company, lender, or other authorized party before sending funds or sensitive information.
Our Services are not intended for use by children under 18 years of age. If we learn that we have collected personal information through the Services from a child under 18 without the consent of the child's parent or guardian as required by law, we will delete it.
We use SMS Text Messaging to confirm appointments, send reminders, notify clients and prospects of schedule updates or important changes, provide property updates, respond to inquiries, send real estate service information, follow up on consultation requests, and provide marketing communications where permitted by law.
You can cancel the SMS service at any time. Just text "STOP". After you send the SMS message "STOP" to us, we may send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, you may sign up as you did the first time, and we may start sending SMS messages to you again.

You may submit a request to know to the address or email address indicated in Section 12. The delivery of our response may take place electronically or by mail. We are not required to respond to requests to know more often than required by applicable law.
You have the right to request that we delete Personal Data about you that we have collected, or correct Personal Data that we have about you that is inaccurate. Upon receiving a verified request to delete or correct personal data, we will do so unless otherwise authorized or required by law. We may retain information where permitted by law, including for legal, security, transaction, compliance, brokerage, accounting, tax, fraud-prevention, or legitimate business purposes.
You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent written permission to submit a request on your behalf, and we may require that you verify your identity directly with us. Alternatively, an authorized agent that has been provided power of attorney may submit a request on your behalf where permitted by applicable law.
You may submit a request to know, delete, or correct Personal Data about you via email at info@rogersreteam.com or at the mailing address provided in Section 12.
Upon receipt of a request, we may ask you for additional information to verify your identity. Any additional information you provide will be used only to verify your identity and process your request, unless otherwise permitted by law. We will respond to verified requests within the time required by applicable law. If we require more time, we will inform you of the reason and extension period in writing where required.
Any disclosures we provide will only cover the period required by applicable law. The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded, where permitted by law. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
You have the right not to be discriminated against for the exercise of your California privacy rights described above.
We may use your Personal Data for the purposes described in Section 2 of this Policy, and may share your Personal Data as further described in Section 4 of this Policy. California law places certain obligations on businesses that "sell" Personal Data to third parties or "share" Personal Data with third parties for cross-context behavioral advertising, as those terms are defined under the CCPA.
We may "share" certain personal information, such as device identifiers and browsing activity, with advertising partners for cross-context behavioral advertising purposes as described in Section 5. You may have the right to opt out of this sharing. To opt out, you may contact us using the information in Section 12.
We do not "sell" Personal Data for money.
Some Personal Data may be considered sensitive personal information under certain privacy laws, including the CCPA. Sensitive personal information may include, for example, government-issued identification number, account credentials, precise geolocation, information relating to a person's race or ethnic origin, political opinions or religious beliefs, physical or mental health or condition, sexual orientation, trade union membership, criminal offenses or convictions, and other information deemed sensitive under applicable data protection laws.
We do not request sensitive personal information in connection with general use of the Site, except where voluntarily provided or where necessary for a specific secure process, transaction, legal requirement, or service requested by you.
We do not currently respond to all web browser "Do Not Track" signals because there is not a uniform industry standard for such signals. Where required by applicable law, we will honor legally recognized opt-out preference signals.
The Site is provided for informational, marketing, educational, and real estate service purposes. Content on the Site is not legal, financial, tax, appraisal, engineering, inspection, insurance, mortgage, investment, or accounting advice. You should consult qualified professionals before making real estate, legal, financial, tax, mortgage, investment, or property-related decisions.
We strive to provide accurate and helpful information. However, we do not guarantee that all information on the Site is complete, current, accurate, or error-free. Property information, pricing, availability, square footage, acreage, taxes, school information, zoning, permits, HOA information, property condition, rental rules, mortgage information, market statistics, and other details should be independently verified.
Any valuation, home-price estimate, equity estimate, market analysis, pricing opinion, or market guidance provided through the Site is preliminary and informational. It is not an appraisal and should not be relied upon as a formal valuation. A formal opinion of value, comparative market analysis, appraisal, or pricing strategy may require additional information, market review, property access, and professional judgment.
When you submit information through the Site, you represent that the information is accurate and that you have the right to provide it. You agree not to submit unlawful, misleading, harmful, infringing, discriminatory, abusive, or unauthorized content.
You may not use the Site to violate law; interfere with Site security; attempt unauthorized access; scrape, copy, or harvest data without permission; submit false information; impersonate another person; upload malware or harmful code; engage in discriminatory housing practices; misuse listing data or copyrighted content; engage in fraud, spam, harassment, or abuse; or interfere with the Site or Services.
The Site, content, design, branding, logos, text, images, videos, guides, forms, downloads, graphics, layouts, and other materials are owned by or licensed to The Rogers Team, eXp Realty, or their respective owners. You may not copy, reproduce, distribute, modify, sell, or exploit Site content without written permission, except as allowed by law.
Some property information may be provided by MLSs, IDX providers, listing brokers, sellers, public records, property platforms, or other third parties. We are not responsible for third-party inaccuracies, delays, or omissions.
To the fullest extent permitted by law, The Rogers Team, eXp Realty, affiliated licensees, team members, employees, contractors, Service Providers, and representatives will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Site or Services.
Nothing in this Policy limits rights or obligations that cannot be limited under applicable law.
You agree to indemnify and hold harmless The Rogers Team, eXp Realty, affiliated licensees, team members, employees, contractors, Service Providers, and representatives from claims, damages, liabilities, costs, and expenses arising from your misuse of the Site, violation of these Terms, violation of law, or infringement of another party's rights.
This Privacy Policy and Terms of Use is governed by the laws of the State of New York, without regard to conflict-of-law principles, except where federal law applies.
